Pay workers on Feb 25; employers told

Cebu City, Philippines. Workers who would be reporting to duty on 25 February 2019, EDSA People Power Revolution Anniversary, should receive the correct rate on that day.

Labor Advisory No. 03, Series of 2019 spells out the rules to pay on February 25, which is a special non-working holiday.

“If a worker is asked to render work on February 25, he or she must be paid an additional 30% of his or her basic wage on the first 8 hours of work,” said DOLE-7 Regional Director, Atty. Johnson G. Cañete. Employers, he added, would only have to multiply the workers’ basic daily rate with 130%.

For work done in excess of 8 hours or overtime work, he continued, workers must be paid an additional 30% of his or her daily rate on said day. The hourly rate of the basic daily wage is multiplied by 130%. The resulting amount is multiplied again by 130% and eventually by the number of hours worked.

Atty. Cañete cautioned employers to be careful in their computation especially for workers who would work on a special non-working holiday, which also falls on their rest day.

In this case, he said, workers must be paid an additional 50% of their daily wage on the first 8 hours of work. The basic daily wage is multiplied by 150%.

But for work done in excess of 8 hours or overtime work during a special day that also falls on the workers’ rest day, they should be paid an additional 30% of their hourly rate on said day.

“The hourly rate of the basic wage will now be multiplied by 150%. The result would be multiplied again by 130% and then by the number of hours worked,” the DOLE-7 Head explained.

He reminded the workers though that the principle of “No Work, No Pay,” shall apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special non-working day. 

The issuance of Labor Advsiory No. 03 is pursuant to Proclamation No. 555 issued and signed by the President on 15 August 2018.
