Submission of docs for new and renewal of applications suspended


Cebu City, Philippines. Applicants for new and renewal of registrations, licenses and permits at the Department of Labor and Employment (DOLE-7) are given time to submit documents after the lifting of the Enhanced Community Quarantine (ECQ).

DOLE-7 Regional Director Salome O. Siaton said that the DOLE will also be focusing on its other programs and services especially on the issuance of licenses, registrations and permits as soon as the ECQ is lifted, adding that the reglementary periods for filing of documents, pleadings and motions at the DOLE are being suspended as of the moment.

For the certificate of registration under Department Order No. 174 for contractors and sub-contractors, submission of new and renewal of applications is suspended during the community quarantine.

“For registrations, which expired or will expire within the community quarantine period, applicants are given extension to file documents after the lifting of the community quarantine for a period of 30 days,” said Director Siaton, saying further that applicants don’t have to worry.

The new and renewal of applications for the Alien Employment Permits (AEPs) can also be filed within forty-five (45) working days after the lifting of the ECQ or GCQ, without the imposition of penalties, she said further.

Same holds true for Private Employment Agencies (PEAs), whereby applications for new or renewal of licenses to operate private employment agencies can be filed within 45 working days after the lifting of the ECQ or GCQ, without penalty.

Also, the petitions for Certification Elections; Inter and Intra-Union Cases; Cases relative to Alien Employment Permits; Labor Standard Cases with finality and Child Labor Cases likewise have some guidelines to follow while the ECQ is not yet lifted.

“The filing of pleadings, motions and all other papers relative to the above-mentioned cases is also being suspended for the duration of the community quarantine. Also suspended is the rendition of orders, judgments and resolutions,” said the DOLE-7 Head.

As for queries and complaints received by the Regional Office concerning the schedule of mandatory conferences and hearings, Director Siaton said, “As of the moment, conferences and other proceedings requiring personal appearance of both parties and counsels are cancelled. Concerned parties are assured that the concerned offices, field office, division or our Mediation-Arbitration and Legal Service Unit will make sure to reschedule the dates of conferences or other proceedings once the community quarantine is lifted,” she explained.

The same guideline covers the Single Entry Approach (SEnA). The filing for a request for assistance (RFA) under the program is also suspended for the duration of the community quarantine. SEnA conferences that have been scheduled during the quarantine period shall be rescheduled once the quarantine is lifted.

For cases with monetary awards involved, the deadline for the payment of said awards is suspended, too, for the duration of the community quarantine. “The DOLE will see to it to reschedule the payment of said awards after the lifting of the community quarantine,” Director Siaton added.

The new set of guidelines are provided for under a Department Order recently released by Secretary Bello – Department Order No. 213, Series of 2020.
