Higher take home pay on August 31, National Heroes Day

Cebu City, Philippines. On August 31, a National Heroes Day, workers reporting to work could get a higher take home pay.

“Since it’s a regular holiday, workers, who will not work on that day will be paid 100% of their daily wage rate,” said DOLE-7 Regional Director Salome O. Siaton. However, she reminded the workers that for them to be able to avail said holiday pay, they must be present on or before the last working day prior to the regular holiday.

“Pwede naman silang naka-leave of absence on the last working day before the regular holiday, provided that such leave is with pay for them to be paid with the holiday pay even if they won’t work during the holiday,” she added.

For work done on that holiday, she said further, workers must be paid 200% of their daily wage rate for the first 8 hours of work.

For work done in excess of 8 hours or overtime work, workers must be paid an additional 30% of their hourly rate on that day. For work done on that day, which also happens to be the rest day of the workers, an additional 30% of their basic wage of 200% must be paid by their employers.

For workers who render overtime work on that day, which also happens to be their rest day, they must be paid an additional 30% of their hourly rate on said day.

“However, due to the existence of a national emergency brought about by the ill effects of COVID-19, employers are given consideration and are allowed to pay the workers with the holiday pay on August 31 at a later time when the present emergency situation has been abated and the normal operations of establishments have been put in place,” added the Regional Head.

Last 21 August- Ninoy Aquino Day, which is a Special Non-Working Day, workers who reported to work could earn an additional 30% of the basic wage for the first 8 hours of work.

However, if the workers did not work on that day, then the “no work, no pay” principle would apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on that day even if unworked.

For overtime work, workers must be paid an additional 30% of their hourly rate on that day. For work done on said day, which is also the rest day of workers, an additional 50% of the workers’ basic wage for the first 8 hours of work must be paid by employers.

Establishments that have totally closed or ceased operations during the community quarantine period are exempted from the payment of the holiday pay.

Labor Advisory No. 27, Series of 2020 indicates the payment of wages for the August 21 and August 31 holidays.
