10-08-2012, Governor’s Mansion, Tagbilaran City, Bohol – Secretary of Labor and Employment Rosalinda Dimapilis-Baldoz and Bohol Governor Edgar M. Chatto, Chairperson of Bohol Tripartite Industrial Peace Council and the lead Conciliator Mediator witnessed the signing of final agreement that settled the labor dispute between the Bohol Beach Club (BBC) Management and Bohol Beach Club Employees Union.
8 months ago, BBC decided to retrench almost 50% of its employees, which prompted the aggrieved workers to file a case before the National Labor Relations Commission and other fora to assert their rights as workers.
The issue that hounded the BBC was eventually discussed during the meetings of Bohol-TIPC through the initiative and the vibrant leadership of Chairperson Governor Chatto and cooperation among its members. DOLE – 7 through its Bohol Field Office Chief LEO Wilson Cenas and Senior LEO Gerry Guidaben and Conciliator Mediator Jay Javines of NCMB –Manila made strategic action that paved alternative ways to mend things between the two contending parties other than through compulsory arbitration. Series of meetings were conducted to convinced the parties to resolve their differences in the spirit of industrial peace.
True enough, all the efforts and energy of the stakeholders did not go into waste, since the parties agreed to settle and signed a compromise agreement stating, the reinstatement of thirteen (13) remaining workers effective October 15, 2012; payment of one month and half back pay; and all cases involving both parties pending before the NLRC, DOLE and other tribunals involving the same issues to be considered dropped and withdrawn. Both parties also warrant and attest that no similar action shall be filed arising from the settled labor dispute.
Signatories to the agreement are the following: for the Bohol Beach Club Management were Roger Q. Lagumbay and Atty. Antonino M. Jumawid; for Bohol Beach Club Employees Union Naliorf F. Canals, Edwin A. Bustillos and Nestor L. Cabada. Governor Edgar M. Chatto and Secretary Rosalinda Dimapilis-Baldoz signed as witnesses to the agreement.
