Election day is a special non-working day

Cebu City, Philippines.May 14, Monday, the Barangay and Sangguniang Kabataan (SK) elections of 2018, is a special non-working day. 

Labor and Employment Secretary Silvestre H. Bello III issued Labor Advisory NO. 08, Series of 2018 stating the rules for pay on said day. 

For work done on Monday, workers shall be paid an additional 30% of their daily rate on the first eight (8) hours of work. Employers are advised to multiply the daily rate of workers by 130 percent. 

If the work done is in excess of 8 hours or an overtime work, workers should be paid an additional 30 percent of their hourly rate on said day. 

If workers are asked to render work on a special day that also falls on their rest day, they shall be paid an additional 50 percent of their daily rate on the first 8 hours of work. In other words, daily rate is multiplied by 150 percent, said DOLE-7 Regional Director, Atty. Alvin M. Villamor. 

Another computation formula will be observed for work done in excess of 8 hours or overtime work during a special day that also falls on workers’ rest day. 

Director Villamor said that workers should be paid an additional 30 percent of their hourly rate on said day. To arrive at the exact computation, employers are to multiply the hourly rate of the basic daily wage by 150 percent. The product will be multiplied by 130 percent and then the result of which, will be multiplied again by the number of hours worked. 

The DOLE-7 Head urged employers to familiarize themselves with the pay rules, however he said that on a special non-working day, the general principle of “No Work, No Pay,” will apply. 

“But if there is a favorable company policy, practice or collective bargaining agreement for unionized companies granting payment on a special day, then workers should be paid even if they would not work on a special non-working day,” he finally said.
